Welcome to Jotsky. These Terms of Service ("Terms") govern your use of the Jotsky iOS app (the "App"), operated by Macay Fischer ("Jotsky," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the App.
You must be at least 13 years old to use Jotsky. By creating an account you confirm that you meet this requirement and that the information you provide is accurate. You are responsible for your account and for keeping your sign-in credentials secure.
Jotsky lets you create and share content — jots, comments, drawings, images, stickers, and profile information ("Your Content"). You own Your Content. By posting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute Your Content within the App and its supporting services, solely for the purpose of operating and improving Jotsky. This license ends when you delete Your Content or your account, except for the limited period needed to purge it from our systems (deleted jots are permanently purged within 30 days), and except where content has been shared or re-displayed by features you invoked (e.g. a sticker you placed on another user's jot).
You are solely responsible for Your Content. Don't post anything you don't have the right to share.
Jotsky has no tolerance for objectionable content or abusive behavior. You agree not to post or share content that:
We may remove any content and suspend or permanently ban any account that violates these rules, at our sole discretion, with or without notice.
You can stop using Jotsky and permanently delete your account at any time from Settings — deletion is immediate and irreversible. We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the App. Sections of these Terms that by their nature should survive termination (including Sections 2, 7, and 8) survive.
Jotsky relies on third-party infrastructure (including Supabase, Cloudflare, OpenAI, and Apple) to operate. Features may change, break, or be discontinued at any time. We don't guarantee that the App will always be available, uninterrupted, or error-free, or that any content will be preserved — keep your own copies of anything important to you.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CONTENT IN THE APP IS CREATED BY USERS; WE DO NOT ENDORSE IT AND ARE NOT RESPONSIBLE FOR IT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOTSKY AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED FIFTY U.S. DOLLARS ($50). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you in the App. Continuing to use the App after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles.
